ntonio Santiago Rodriguez Hernandez's attorney, Patrick Tracy informed the judge he would not be able to try the case in February due to a schedule conflict. Mr. Tracy has a different case set to go to trial in February.
Judge's Response: The judge informs Mr. Tracy that he will hat to relieve him from serving as Antonio's attorney because Judge Neary is determined to set a trial date for February 2019. It appeared Judge Neary explained that Mr. Tracy was sent a notice around August 16, 2018 that the trial would be scheduled for February and that would've been when Mr. Tracy should've addressed his need for accommodations but since he didn't, the judge has no other alternative other than to relieve him from his duties.
Attorney Response: Mr. Tracy told the judge that he did notify the DA when he received the letter that he had a different case going to trial on February 25, 2018 which would preclude this case from going to trial in February..
Judge's Response: Mr. Tracy's schedule conflict precludes him from serving as the attorney, so he is letting him know he will be relieved and replaced with another attorney.
Attorney Response: Mr. Tracy he feels he and his client have a good relationship and that the amount of work he's done on the case thus far is substantial. He doesn't think he should be relieved from serving as Antonio Santiago's attorney, but rather, he believes the court should accommodate his schedule.
Judge's Response: The court cannot accommodate 13 attorneys because they probably have issues to and hopes they've made adjustments. He tells Antonio's attorney that attorneys don't make the schedules, the court does.
Attorney Response: Mr. Tracy wants to put it on record that he was notified that the DA is attempting to collect DNA evidence which is yet to be examined, nor has it generated any reports. So they haven't received them or been able to let their experts look over them which will take a significant amount of time.
Judge's Response: If it comes to the point when this has already gone to trial and the DA doesn't have the DNA evidence, they'll have to live with that.
Attorney Response: When he received the judge's notice, his other case for February had already been scheduled for months before that. The court for that case had a set a schedule for 8 months down the line as apposed to only a couple of months. He suggests if the judge picked a date in July, he could try the case.
Judge's Response: Judge Neary understands, but he's going to schedule the case to return on October 31, 2018 for new counsel to be assigned to Antonio Santiago.
